The law of this country is very specific in regards to illegal immigrants. Illegal immigrant has rights as human and also protected by many laws of this country. From abuse to criminal prosecutions. Like any citizen, they have the rights to a fair trial - not guilty until found guilty. If they're found guilty, then they deport their **s out of here.
To answer your question, yes they do have rights but some of those either violated or ignored by means of ignorant.
On the other hand, the immigration or Homeland Security also very specific when come to hiring an illegal or undocumented immigrant. Your company for one is liable to be fined (if I'm not mistaken $25,000 per worker) or closure or both if found guilty hiring illegal immigrant to work. As a deterrent
Boils down to, you ended up hiring some lazy a** punk off the street who's lazy a** is to smoke pot all day.

You can only hire an undocumented worker if s/he will perform the work outside of the US tax zone. In Guam, say (where there are special rules); or in another country.
But you could hire a company formed by that undocumented worker in his or her own country or elsewhere. This has been the loophole used by government contractors and big firms to avoid prosecution themselves. (Only certain forms of labor are permitted in law: such as installing and repairing equipment originally sold by the foreign firm and imported to the USA, and some kinds of lecturing and artistry etc.)
Even an undocumented alien, unless declared an enemy combatant, has constitutional rights within the USA. Some protections exist, some are lost.

So while purporting to punish the alien, it punishes anybody he injures -- unless that person has adequate uninsured motorist cover.

Yes you can hire him and face the criminal penalty. Yes his
legal rights are protected until he is deported. We are a Nation
of Laws and pretty good ones at that, and we must all see to it
that those Laws are always fairly applied equally. If we allow
personal opinion to magistrate our Laws we are all doomed.

If you want to stay in business I wouldn't suggest it. Besides, just hire an actual US citizen who needs a job.
I can't think of any reason you'd want to hire an illegal, except that you want to pay less than minimum wage, but that couldn't be it, could it?

i would really urge you to hire an american citizen who is looking for work..there are are many who need jobs and not only want them but deserve them because they are citizens of this country. please do the right thing and find someone who is legal and just wants to work and make a living legally in this country. you'll be doing everyone a favor, including yourself. then you won't even have to worry about it at all. it's a win/win situation...

You can hire one but then you can expect the INS to come calling. You won't have to worry about his legal rights. That happened to my boss and he became so paranoid that he promptly laid off all employees who had an accent or who was married to a person who had an accent.
