before all this happened, he had jury duty all week the week before..

my husband is a cna, and he was transferring someone who was in a shower chair into his wheelchair and the resident decided he was just going to sit down even before the wheelchair was near him and my husband had to quickly get a grip on him so he wouldnt fall. he had 2 people that saw this happen and confirm that it wasnt his fault.. and therefore he pulled his back muscle really bad and was put on light duty, now he's on some stupid muscle relaxer cause doctors are ******* stupid..

anyway, he's been working at this place for about a month- and i dont know what the regular policy for workers comp is, but they're only giving him 50% of his pay until he's better because he got hurt.



is this legal????????????

we're in massachusetts, not canada.. i'm not looking to sue or anything.. but how they expect us to live on 150 for a whole week with a child to feed is beyond me..

also.. he does work a 40 hour week.

yes this is totally legal. That is usually all that they pay. They dont have to pay more than 50% sinve he has only been there that long. He is lucky it already kicked in at all some places it dont kick in for 60-90 days.

Workman's comp pays on a 40 week, your husband may have been working more hours than that. It may be pro-rated to the point that it looks illegal. I've sprained my back numerous times and finally ended up having a chiropractor align it. Each time, it took about 4 to 5 days of doing absolutely nothing to fix.

Your husband should get 80% workers comp. It's standard in Canada. He can also claim for pain and suffering. It's better to contact Layer. Most of the time u don't have to pay Layer upfront. U pay 10 to 20% of the money u receive to layer when everything is settled

Look in the yellow pages for a workers comp attorney. If he is injured he should be off work completely until he is well. A back injury will only get worse if not treated properly. Mine has been messed up since I was 20 years old. I now am 54 years old.

i got it the opposite way my girl friend is a cna, you are lucky to get anything, as there are a ton of rules and regulation at each place but if you got anything i still think that's good because usually they don't give any body anything til they have established a period of time to see if your husband will be kept or dismissed in the break in period.probationaries? but they also could be saving themselves from a law suit because inadvertently it will probably lead to a dis-missile under the inability to return to work, if the doctors are in on it stay with it, the pills are doing allot of good if the guys torn up from the results, it can take years to get over some tears and sometimes they have to operate just to get rid of the pain and suffering because allot of that stuff never heals on its own. you need to see a lawyer if you think their going to dump him because of the situation
