My (soon to be ex) husband started a business after we were married. He now has it for sale, but I'm pretty sure it has increased in value since he listed it with a business broker. He says he can't increase the price because he signed a contract for 1 year, and besides he just wants to sell it and be done with it. Am I entitled to half of the business value, or half of whatever he decides to give it away for?

Depends on the state which you reside in. Here in California, you'd get 50% of the proceeds from the sale of the business.

Is your name on the business? You'd have more control over how the sale takes place if it is.

Most states each party in the divorce is entitled to 50 percent of any assets acquired during the marriage. Of course that is negotiable, that is the purpose of the blood sucking lawyers.

i would get an attorney. in Texas you have to agree on a price and then go 50%. now what is this one year contract for? he is not suppose to sign any contract within a certain time after y'all separated. girl, get a attorney, besides he'll be glad if y'all the most money. Or does he have something up his sleeve?

Unfortunately that will be decided in court between you and the attorneys. No two divorces are the same no matter. I've never figured it out but some people get away with murder and some people loose out.

That sounds like one for the lawyers to hash out in court...there are many factors to consider in such cases...but if it was started AFTER the marriage, you should be entitled to half.
