he calls 6:oopm the nite before move in date. which is 11-3 . he paid me 1st month and security on 10-30.the check for move in post dated 11-3check memo says for nov. and security. no lease yet. to be done apon move in. I turn down 10 people that wanted to see the appartment since he wrote me the check. Can i keep nov. rent and return security deposit at end of month. or do not have any rights.

You need to refer to the property code provided by whichever state in which your property is in, with regard to landlord and tenant rights. For example, if you were in Texas, you would easily find this information by doing a search for "Texas Property Code", where the state in which you own the property would replace Texas in my example.

You're the landlord, and you took his money but you don't have a signed lease..... now he doesn't want to rent after all.

Usually, the answer lies in the terms of the SIGNED LEASE.

Return his money fast and hope he doesn't mention it to an attorney.
