Is there any recourse in spain when a judge says there is no case to answer in a clear case of fraud?

my lawyer told me that the contract I signed was a nonsense and that the con man who wrote it, could end up in jail for up to four years for fraud, yet the prosecutor said there was no case.

Yes, you can recourse to a superior court. Ask for legal advise, recoursing is not cheap.
