my sis got a arrest warrent yesterday. she hit somebody car in march and ran away and after few min police got her and that time they towed her car and she paid 1500$ to take her car back. now they send this notice after 8 months. they said she need to go to bail bond and pay them 500 to get a date or pay 5000 to the police dept or otherwise they will arrest her. can anyone help me plz i don't know what to do. it happen first time in our family and she is very nervous she didn't have a job either she can't pay this much money. please suggest me something.we live in san jose,ca... anybody know about a good lawyer who can help us and charge her less money.

This sounds fishy to me...No body has to pay the police not to get arrested. sounds like fraud. Just let them arrest her, and when she gets to holding, tell them that she is entitled to a public defender. that is free to people who are unable to pay

You didn't mention what she is charged with. Leaving the scene of an accident perhaps?

It is likely that when the "police got her" and towed her car they gave her a citation for leaving the scene of an accident, and possibly other charges as well. Then, from your description, it sounds like she failed to appear in court or otherwise deal with the citation.

If she has no money for an attorney, the Court will appoint an attorney to represent her. She will need to qualify based on her finances. However, if she or your family can't raise the $500 for a bailbondsman, or the $5,000 for the cash bond, then she will remain in jail until such time as she can appear before the judge to deal with the citation(s).

In many cases, an attorney can assist with getting the warrant withdrawn, and making arrangements for the case to be settled. You should contact your local or state bar association for information on obtaining an attorney.

I will give you some advice you don't want to hear. It is the same advice my father gave me more than 45 years ago.

The only thing worse than an expensive lawyer is a cheap lawyer. Your sister is going to get run over by a system that has unlimited resources. It is imperative she find a good attorney and quickly.

One other bit of advice you will not like. The advice you get on Yahoo Answers is worth exactly what you paid for it. And that is NOTHING!! It is a huge mistake to try to resolve such a critical matter on an anonymous site where no one is accoutable of anything.

Is there a Citizens Advice Bureau you can call?

Maybe you could go to the Police Dept. and ask for an explanation. There might be a stuff up in their records or something. Do you have receipts for the $1500?

There are lots of free legal aid places try going to http://www.google.com and searching for Free Legal Aid in San Jose or something.

Sounds like she failed to appear in court on a leaving the scene of an accident charge. She needs to speak to a lawyer.

When your sister got out she was release to a bail bond agency the judge set the bail to $5000.00 of curs you don’t haft to pay that amount. You pay the bail bond 10% of that $5000.00 which comes out to $500.00.She should have paid the $500.00 to the bail bond to get out of jail first now sum one would have to do that from the out side . Now she is out the judge set a court date for here to return and if she don’t show up they will send a warrant for here arrest and if she don’t show up the bail bond is responsible for that $5000.00 I don’t think they wont to pay that much so it would be better if you your sister pay the $500.00. In the east, there is an organization called Legal Aid. They are attorneys who help lower income people. Maybe they, or something similar, exists in your area. Good luck.

my sis has been arrested b4 & it scared me so much I cried but when i got home that evening from school she was there....anyway don't woory it will b ok just try to help her get a job and mayb help her pay 2 if you have time to post a question on yahoo! you have time to help your sis get the $ she needs
