I'm looking to file a claim against a certain county in a certain state for releasing a copy of my birthcertificate to someone who was not given permission to recieve a copy. This person then used my personal information to commit fraud. Think I have a good chance of winning?

Most states will give birth certs to the person who's name is on the cert, the parent of that person, a grandparent or grandchild, and the persons children without written permission from the person whos name is on the birth cert. Check the laws in your area by typing in county recorder for your county and checking the their site. Also, get all info regarding what this person did with your birth cert and talk to a lawyer. The lawyer in your area will know what your chances are of winning better than anyone here. Good Luck.

Honestly, I'm not exactly sure what the US state laws are. But I know it does go under fraudulance, and it's a very serious crime, if I'm not mistaken, it's also a felony in many US state laws. If you have proof and evidence that this particular person has done this, and proof that you did not give permission, then I say your chances of winning are extremely high.

So if you have enough evidence and proof. I would say you would have no problem winning.

No. Unless there is some peculiar state law to the contrary in your state, state & county governments are immune from suit for administrative errors.
