or talks about everyone while they are standing right there and you have went to managment and even talked to the owner about the situation and they have done nothing do you think if they fire you that you will have a case?

The whisle blowing act will only apply to you if you are directly effected by the situation. Go to http://whistleblowerlaws.com/protection.htm to see if it applies to you. The eeoc only applies to descrimination and if they are doing this to everyone it may not be a case for the eeoc there is a good Q&A at http://pages.prodigy.net/cheatham1/eeoc.htm. If the outlines on these sites apply to your situation, you do have a case and should contact the eeoc imediatly. They will tell you if you have a case or not. No one will know if you call for information.

If the conversations are having an effect on you to the point that it is effecting your job duties and you have been to management and reported that your job duties are being effected and they do nothing, then yes you may have a harassment case. If you pursue it you may even be harassed more. Think through your options carefully and weigh the positive and negative aspects of taking the next step.

Depends on your state of residence. If ther person who is evil is a "protected group" - ie disabled, minority...etc. And also what state your corporation's encorporating documents were filed in.

For instance, in Texas, it is an "At will" employment state, so for most things,you have no recourse. They can fire you if they do not like your haircolor.

You can file a claim for creating a hostile work environment. It's a very difficult process and it's almost always their word against yours and hard to prove. If you have HR.. go to them and discuss the situation.
