I have gone through this and it is a pian in the butt. First of all are you marrying the childs father because if you are you have to pay a lawyer & go to court and testify that yes so & so is the father and they want that last name and then the judge will say okay and then papers are filled and a new birth cert is made. If it is not the childs father then you still have to get a lawyer and get the father on the birth cert to surrender parental rights and your new husband can abopt him. It will cost anywhere from 500-550 and up. Good luck!

It depends on how old your son is, and especially what country you live in. (Everybody seems to think that internet is just for the USA).
I'd suggest you consult a shark.. errr a lawyer about this - it should not be expensive.

Why would you do that? So everyone can have matching last names? That is his identity, leave it alone. What are you going to do when you get divorced, change again? These days, nobody cares if your last names don't match.

Legal name change:
http://www.google.com/search?hl=en&q=legal+name+change
Step-parent adopting child (name change):

If your son has his biological fathers last name you may want to consider not changing it because he is carrying on the name from that side of the family.

Your husband doesn't have to adopt him. You can file with a court for a name change.
