If you had cigarette butts in the ashtray of your vehicle in a high school parking lot, do they have any right to punish you?

Now, like others have said, they would have a lot of work to prove that you were smoking on campus (where you vehicle is parked), but if they can do that, then you could face punishment. Otherwise, who is to say that the vehicle does not belong to your parents and they were their cigarettes?

On top of that, if you really want to play a trump card, what were they doing peering into your vehicle? If you were to simply ask if they had "probable cause" to look into your vehicle, it might back them down. As this is not a police enforced area though, that might not work as well, especially since the butts were in plain view.

My suggestion, if you are going to have butts in your ashtray while your vehicle is at school - close the ashtray. Ultimately, if they are unable to prove that you were the one smoking them they can not punich you. I am guessing though that you are a student of that school - if so, more than likely you are under the age required to purchase cigarettes. If you are indeed a minor, the school might call your parents and inform them of your smoking. That might be worse than anything the school would do to you!

Most schools do not allow any sort of drugs, alcohol or tobacco on their property. Since the parking lot is their property, if you brought cigarettes or cigarette butts onto the property, you are subject to what ever punishment is allowed in your schools code of conduct or school rules...

For the most part they can do whatever they want at a school, but that is pretty freakin' ridiculous. It's not like the car is necessarily just yours. Nor is it illegal for minors to smoke - they just can't buy cigarettes. The only legitimate course they may have is if they saw you smoking on school property and it is not allowed. I'd ask them to tell me what exact rule I broke that they are trying to punish me for and that if they can't give a legitimate answer, then it appears I have broken no rule to receive a punishment and consider the matter closed.

I don't see how they possibly could unless they could prove that the butt's were your's! Maybe one of your parents drove the vehicle before you. I know my daughter has taken my vehicle to school and I have butt's in my ashtray.

No they shouldnt. I borrow my parent car and they both smoke so there was allway cigarette butts in the ash tray. I would be piss If I got in trouble for them since I dont smoke.

It's their lot....their rules...but I don't understand why some one is poking around the lot and peeking into cars....Has there been some breakins...maybe the security people are the ones doing it.....but in the proccess busting people to look like they are ligit.
