Normally, you should be able to know if the person is mentally challenged or not. I have a friend who is mentally challenged and I could tell the first time I meant her, but that didn't stop me from being friends with her. It also depends on the situation, if you could laugh or not. If it is something they couldn't help but doing, than NO, but if you knew they were being silly or something of the sort, than yes, I would laugh along with them.

we were at a church recently...in the afternoon there was a car show & the band played ...they were really good. Some girl got up (she was in her 20's) and she was really getting into the music...suddenly she started banging her head on a brick wall...hard.....we got tickled....not laughing at her...just at the circumstance....she didnt seem like she was mentally challenged...but after seeing that...maybe she was...we felt bad about it...because we never would make fun of the less fortunate.

Probably. Because the mental part won't even be a factor if I don't know. But if I did, Unless they were trying to be funny I would not laugh.

No that's rude if they can't help it. You shouldn't make fun of mentally challenged people your kids might turn out like that and you wouldn't want people laughing at them.

Yes, but I don't see myself doing it out of meanness as I've often caught my own self doing silly things, and - when others have laughed - I've just joined in. Human beings are very funny and entertaining creatures, and I don't see the harm in any laughter that doesn't arise out of a mean-spirited desire to wound someones' feelings.

Yeah, just because they are doing somthing silly it does not mean they are not trying to be a goof, they may be trying to make some one laugh. But if the situation is serious or they are not looking for attention then no.
