I work for a pizza place as a deilvery driver. I'm 22 and in college, so it works for now. Anyway, a bad check was recently accepted by me on a delivery and now the owners are attempting to make me pay them back for that. Now, I have never signed anything agreeing to this. So first off I know they can't FORCE me to pay it. But unfortunately I live in a state where you can terminate anyone for any or no reason at all and I don't really want to resort to that. Anyway, a friend of mine and I were talking and she said that a bounced check is the companies responsibility and that they can use it as a tax write off and because they are required to have business insurance that they will get the money back one way or another without me having to pay it. She said to her it sounds like they're trying to screw me over. Anyone know about this? I would prefer documentation or something and I'm in Michigan. And I will reward the best answer with the best answer cause it's only fair to do so. Thanks!

It depends on whether or not you were following company policy when you accepted the check. Did your employer authorize you to take it and did you check ID? They probably do not have the right to make you pay for it in court but they can fire you.

If you do pay for it, try turning it over to the city attorney for collection. Many places have made it a crime to write a bad check and sometimes you can collect up to hundreds of dollars for damages. Heck if I was a business in some of these places I think I would hope people wrote them to me. I'd make a living just sitting around accepting bad checks and collecting extra penalty money.

After having your pay check bounce, why on God's green earth would you cash a fellow employee's check and take that chance again? Why couldn't that fellow employee go directly to the boss's bank and cash it? You are out the money and any lawyer is going to ask you what I just did. Plus if you were to go to court, the prosecuting attorney will have a field day with the supposed theft charge. You could file a complaint in small claims court, but you would have to file it with the co-worker whose check you cashed that bounced. You cannot sue the boss for cashing their check. They on the other hand have to get the funds reimbursed from the boss. Unless the police have a search warrant and justifiable reason to search your home (search warrants are granted by the judge) then I wouldn't worry too much. It has to be a theft of over $1,000 (with proof of value) before they will issue a search warrant. I suggest if you are totally innocent and a victim of foul play that you get another job elsewhere and quit jerking around with these people.

Go to the house you delivered it to and try asking nicely. Tell them that you don't want to involve the law so could you make good on this check?half this week & hlf next week if u have to.I have lived in 3 states and scumbags write bad checks. I know the cop or sheriff will go to the address of a bad check in 3 states. Also note a small business 9 outta10 cannot write off a bad check.

What is the company policy about taking checks? If the company accepts checks for payment then it is their responsibility. They can turn it over to the Check Fraud or Hot Check Office of the DA.

If the company policy is no checks and you accepted it, then it is your responsibility. You will need to pay the company and then turn it into the DA.

With as big a problem as Hot Checks are, I can't imagine you DA would not have a Hot Check or Check Fraud Office.

Michigan is a pain because any employer can fire you at any time for any reason.

That being said, unless they provide you with a cell and access to a service that can verify the check, or a no check policy, you would have a damn good case for unemployment benefits. Document it everything.

If they fire you, sic a union on them. It is Michigan after all :D

No I don't think so you just delivered the pizza the check was made out 2 the company & you probably don't know the person not unless U signed a contract stating this otherwise I'd say nope this isn't your debt.Good Luck

im guessing the check is probably not much more than 20 bucks.
just pay it and save yourself the grief of getting fired for something so stupid. of course its wrong but it would be worse
to lose your job over a measly 20 bucks.

Next time - contact employer and get his OK to accept a cheque....Generally cash , credit/debit cards are the usual forms of payment.
