mother is sueing for forgiven back child support. we now have custody of the boys, who turn 18 in a few months. can i give that money to them?

If it was forgiven (legally)--it can not be resurrected after the fact unless she can prove to a judge that she was coerced into forgiving those arrears. If you still owe arrears (which were NOT forgiven) then you do still have to pay to the MOTHER as she incurred the costs of 'raising' that child while support went unpaid.

if it was forgiven and you have proof that she forgave it, then she won't get anywhere sueing for it. if she does win, they ask the judge about putting it in trust for your boys instead of paying her directly.
