they told the parent on the 14 yr. old son that they were suing her for not controlling him when he was at the mall with friends he is going to court and was banned from the mall

Yes they can. Parents are responsible for the actions of their children. The cutoff age is usually age 15. The courts feel that a child of that age or older knows the difference between right and wrong.

Depends on the state.

Some states do have laws that allow a business to sue the parents of a minor, with or without criminal charges against the minor. The amount they can sue for is probably limited to the actual loss plus a statutory amount.

It's a civil action, and the parents can be held liable, even if not present at the time.
