If an order of deportation is appealed the party has a right to be taken before a judge to have a hearing. If it were a criminal proceeding there would be a right to a trial rather that just a conviction by the police. It is just the way the law works to protect a persons rights.

Because they are allowed to appeal, A right to appeal any court verdit can not be denied anyone
