Legally, no. Unless the branches extend over the property line. This is known as aerial trespass, and she has the right to trim to the property line. However, there are other possible considerations, such as: Is the tree in good shape and not a danger to her property or person if it comes down in a storm? You would be liable for the damages, and an ounce of prevention is worth a pound of cure. Does it block her view? If you are really adamant about keeping it, do nothing. However, if you are not, perhaps a compromise could be made. You trim/remove the tree, and she pays to have another planted in a location that is better for you. That way you both benefit, not to mention that it might create the beginning of good relations. Neighbors are one of your best defenses against break-ins, vandalism, and such. Good Luck.

That is trespassing and vandalism. My neighbor is threatening to do the same to my Sycamore tree. Some branches are over the fence into his yard. He has been told that he can clearly trim the branches that are in his air space but not mine. He is worried that my tree might fall over into his yard and take out the power lines. If that happens, then I will be responsible. Until then, he needs to leave my tree alone.

No, this is not legal for her to do. If you have pictures of how it looked before and how it looks now, I bet you could sue her. I would.

Nope. What's on or over your property is your responsibility. If it were overhanging her property, it would be her responsibility, but that isn't the case.
