When you buy a laptop at a yard sale, you are usually buying as-is. That being said, you bought it, it is now your responsibility to take care of any maintenance costs associated with it. I can't speak for the person you bought it from but I can speak for myself, if I sold you the laptop and you came back and asked me that, I would pretty much say what I posted above. Of course, if Windows XP is installed... and you don't have the recovery disc, you will have to buy a new copy of Winodws and a a new hard drive and basically start from scratch and that's nothing to say of finding the drivers. I couldn't tell you whether it was any good or not without knowing the specs.
You bought as-is... it's your problem now, not trying to be harsh, that's just life.

You can get a laptop hard drive for pretty cheap, figure around $50 or so for something in the 20-30 GB range. you won't need more than this, if you did you would not have bought it at a garage sale.
you can still use it without a hard drive though, you can download a linux Live CD. Check out Ubuntu.com, download the 6.10 live cd, and boot it. in a few minutes you can be browsing the web, sending e-mails and writing papers. Get yourself a USB thumb drive (512 MB to 1GB are pretty cheap now) so you can save data, web pages, documents etc.. The live CD comes with browsers, e-mail apps, and a full office suite that can open and save in ms format. Performance will be slower because you are using the CD, but you will have a great, cheap experiance. Good luck!

It doesn't hurt to ask - the seller may go for it. But I have to agree that you got a decent deal. Search for a cheap drive on the web, and you may be able to get the whole thing installed for $100.
Alternatively, if you want to recover the hard drive, try a data recovery company like dtidata.com, harddriverecovery.org or ontrack.com.
They'll likely be expensive, though, so your best bet remains to buy a new hard drive.
Also, make sure you have the operating system recovery disk!! Without this, you may have to put out for a new copy of Windows as well!

Yard sales generally carry a policy of "sold as-is" but you could try asking the seller if he/she would split the cost.
A new laptop hard drive isn't that expensive. Search for "2.5 hard drive" on a site like Newegg.com. You would then have to purchase a new copy of Windows XP, which might be another $80.

As the old saying goes..."buyer beware". The prices for laptop hard drives have come down alot. I've seen a 60gb drive for $50 or less. Do research shopping on the internet.

I ditto what Dickn2000 says!
Toshiba is a good laptop manufacturer. Take it to a local Computer shop and have them install a new HD for you.
You'll still have a decent Laptop for under 400 bucks after it is all said and done.

The question is, did they sell it knowing the hard drive was bad. They most likely did. A new hard drive will probably run you at least $100.
It is hard to say, do you know the exact model of the laptop?
