A friend of mine is currently having trouble with a deposit she put down on a bed. She postponed the delivery, after putting $100 down, and then was not able to get in touch with the person. When she finally did get in touch with her, she asked for her deposit back, saying she didn't want to deal with such an unreliable company that you couldn't even get in touch with. The woman basically said she was beat for her money, and has refused to give my friend her last name, or the name and phone number of her supervisor. My friend has no other person to contact about this, and has pretty much given up hope of receiving her money back. Is there any other course of action she could take??

To start with do you know if they are incorporated? You could contact the Secretary of State if they are incorporated. They would have the names and mailing address of the owners. If they are a small business they would of had to of gotten a Business License from the City/County where the Business is located. In that situation the City/County would have all the owners names and mailing addresses.
Did they give her a receipt for the deposit, if they did was there anything on the receipt about it being a Non-refundable Deposit?
Sometimes in the retail business when you have to order something special, the deposit could be non-refundable.
If she didn't get a receipt, in my opinion that is bad business. I do hope she gave them a check in the event she needs proof.
If she was given a receipt and there is nothing about the deposit being non-refundable, I would call the Better Business as well as contacting the owners.

That's kinda the point of requiring a deposit - to ensure that you go ahead with the deal, and if you don't, the company keeps the money as compensation for the trouble it went through and any loss (such as not selling the bed to someone else because they thought your friend was purchasing it). However, the fact that the deposit was structured in this way must be known to the purchaser. Your friend needs to read whatever agreement she signed or receipt she received. If there is nothing, then this should be a simple cancellation of order and her money should be refunded. Your friend can file a police report and/or a complaint with the Better Business Bureau (www.bbb.org). This woman she is dealing with is definitely shady. She needs to let your friend speak with her supervisor. I can't tell you how to make that happen, though.

yes, you can email me as well...she really does not need the last name of the person if they refused, she needs to file suit against the company she was buying the bed from, and when they are served they will know she is serious then. However how was the deposit paid, and do you have a receipt. ( you just need the company name address and tell what happened on the court answer) also include the court cost of along with the 100.00

Now if don't call them again go down there and just ask to speak to the sup or discuss with a manager about your agreement. Make notes of everything that happens if she plans to sue. She needs to also get a police report, when you go there and they still refuse that's when you call the police and make your complaint

SHE CAN GO TO THE BETTER BUSINESS BUREAU AND REPORT THEM. ALSO TAKE THEM TO SMALL CALIMS COURT.
