Does anyone know if the 500 foot rule for non smoking near a school is a federal law or a michigan law? What are the penalties? Where can i find a copy of this law?

I just went to Michigan.gov and did a search that came up with nothing. I found a couple cities that have enacted bans, but I was unable to find a Michigan law.

However, I searched for federal documents and came up with the Pro-Children Act of 1994. This act specifically addresses smoking INSIDE schools. I read the entire article that the Center for Disease Control published and nowhere did it mention the 500 feet rule. Here is the link so you can check it out yourself.

There may be another Act that added to this one at a later date. Try www.firstgov.com they search all the major federal databases to find information.

I agree that the politicians and fear-mongering mendacious media have turned them into targets. For a very modest amount of money though, more then half the schools in the U.S could be made safe. Often with just simple modification of what already exists. But the political/media aim is to gut the Constitution and make the people defenseless. All that needs doing is strong fences with sallyports for entry and exit, and large emergency gates remotely controlled with maunal override in case power is out for internal emergencies such as fire. Most modern schools already have a fence which could be upgraded. Anti-firearms legislation passed by idiots in an emotional stampede caused by the media will work about as well as anti-drug laws do.

Michigan's statewide smoking ban is called the Dr. Ron Davis Smoke Free Air Law. It amended the original law known as Act 368 of 1978. We've detailed state by state laws here:

That I know of no existing Federal law exists that bans smoking. It is generally done on a state or even local level. So in response to your 500 foot question I don't see it explicitly in the MI law. Though the MI law is difficult to find online (we have it sourced in the link above) and it could be a local level law. Or as Gem said there may be some Fed law specific to schools that exists but not any that I know of.
