I purchased a bedroom furniture set from Lack's furniture. I got a great price as this set was being discontinued. I did the 12 month no interest contract. Now I am being told the furniture is no longer available. They would like me to come in and pick out another set, at a discount price of course. They want me to cancel the first contract and start over. I want them to honor the contract in place. What is their obligation? What is mine? Is this what is referred to as "Bait and Switch"?

If you did not receive the merchandise then call your finance company and they can cancell the contract. You are not obligated to have to buy something else. Find the manufacture and item numbers and search online for the merchandise and then create a new contract for the store that has it. Also most companies that drop a line should have notifed the furniture store prior they should call the furniture rep and have them do a trace to see if they have stock left in warehouse or can find another dealer who still has the items and they can work it out for you.
