Is it Federal or State court? I believe it is state, but I'm not sure. Anyone know for sure? This study pertains to international travel.

Here in Delaware, it would be with the Family Court (State) where the person who has custody resides. I believe there must be a custody order (or at least a temporary custody order) in place for this motion to be considered.

you file in the local courthouse, in the state and city the child resides in. I forget what it is called, but I had to do it once to keep my ex from taking my son out of the state of Virginia.
