Anyone know if you can take CSA to court for not doing thier job?they have known where my childs father is for 18 years and he has been working the whole time but still l have had no cash from him,they have no excuse,lt seems if l am owe anything to anyone they get it out of me quick enough!!!

The upside is...

If you can show they were negligent or failed in their statutory duty of care that resulted in some type of damage or loss then yes you can.

The downside is that it could prove to be expensive and the courts don't like giving judgements like this in favour of the public in case there are a flood of similar cases. What they call in the legal profession, "opening the floodgates."

Contact your local CAB or a specialist solicitor.

I don't know if you can, I'm sure it could be done; my best advice to you is consult a good attorney; I would hope with the proper documentation and proof of what you have stated; one could escalate the collection process for you. This is a common occurrence everywhere, not just with men; but women also. They should be called Child Support UNENFORCEMENT! They make threats to do this or that when people don't show up for their hearings to establish support, or pay support; but never carry it out!! It is the laugh and the butt of jokes in the courts everywhere! They don't even check income statements in many courts, if you say you make a certain amount; they think you are being truthful! God Bless all the parents who do realize it is their obligation to support their children, financially as well as being a role model!! Just keep in mind...this money goes towards taking care of your child/children, not in the pocket of the custodial/residential parent!

Probably not - I think they're being shut down for being a bit useless. It sounds like you have first hand experience of this.

You could probably take your ex to court. If the CSA have deemed him liable to pay you and he's failed then I think you could chase him through the small claims court.

Probably not, most child support agencies are aligned with the county prosecutor's office.
Getting anyway with those people is almost impossible. They can give you a million and one reasons why they didn't pursue any action against him.

It would probably be easier to sue the father in county court.

call your county support agency line general number, or call a lawyer in the phone book that will give you free advice

speak to the CAB and i doubt you can take them to court unless you have mega bucks to be honest.
see what your rights are with regards to the matter.
