to pursue any payments. she sent me an eviction notice because i hung up on her. she had no cause to break the year lease i have with her and her name is not on her husbands property she is filipino and married a man from here. she is trying to take the property back because she says she is spoiled and noone talks to her like that. i have sent certified mail asking her how she wants the balance of the rent money and no reply. im confused. i have a motel business and 4 apartments and a cafe here. she told the other renters from the apartments not to send me my monthly payments because she is evicting me. nothing filed as of yet. help

You need to get a landlord-tenant dispute lawyer. What she's doing is illegal.

Send her a certified check from your bank (certified mail of course).
If she fails to accept the letter, you have proof of her refusal.
If she accepts the letter, she then has the check.
What she does with it is up to her, but you will have the receipt of the letter, the certified check, and more importantly intent to pay.

Be careful...if the reason for eviction is not nonpayment of rent, you may be preparing for the wrong battle.

can u do one thing.Just furnish the details in the court like u r apartment no.,street no.,etc,and the reasons behind it. Like u mentioned above and start depositing the rent u have to pay the leesor.it would be in u r favour if at all she moves to court to evict u.And inform all of u r customers and known people about the fact and clarify the situation to them.I hope it works with u.

She hasnt filed anything yet because you are not late enough. Once you have failed to pay your rent, whether its because she refused it or not, and she has sent you the required notices then she will file. Without a moments waste, call a lawyer immediately or move. These are your only two options.

You should open a deposit in a Bank at her name, pay there the rent and notify by a letter with recipt of return. Show the contract to the bank, say that you are not able to contact the leasor and they should open the deposit. If they don't ask in the local court how to do it.

Send it certified check, certified return receipt (mail)... try to make sure that it is there before it is late... once it is late she does not have to accept it in any form or fashion.

cya and take her to court. record everything that you have made many attempts to pay her. put your money in a separate escrow account to prove you have made reasonalble attempts to pay her, and her is the money...have facts not hersay. seek an attorney.
