If a child was placed in an adoptive home due to the termination of the "birth parents" rights, can the adoptive family say "I don't want this child anymore and decide to give him/her back to the birth parents? (This is of course providing that the birth parents have regained control of any situations leading to the termination of their rights) What would have to take place in order for that to happen? How would a "birth parent" regain his/her parental rights? Who is responsible for the care of the child? In this particular case the child is 13 years old. Help?

Unless the birth parents "adopt" him back, no. The now adoptive parents would have to put the kid up for adoption and the process would go in reverse.

The child will have some problems for the rest of his life. You shouldn't make a commitment like adoption & just decide to give up. You are that child's parents now. And now more "parents" don't want anything to do with them. Parent's are supposed to love you the most. As he gets older he will never believe that someone really loves him & he will have attachment issues like crazy. Good job. Sounds great.

That's a good question. The previous poster said no but didn't elaborate. I would THINK so if a child is adopted that means that the adoptive parents are his PARENTS and they have sole authority over what happens. So it would seem that they would be able to go and sign over custody to the biological parents just like we regular people can go and sign over custody to someone else. But that's just common sense.

We all know a lot of time the laws in the good ol' US of A sometimes make no sense at all.

No if the adoptive parents decided not to keep the kid they would return the kid to the division of family services. It is then up to DFS to decide where the child will be placed.

I do feel if you at one time agreed to adopt and care for this child it is pretty heartless to "give him back" because things are not going well. He is at that age. He will settle down, get him weekly therapy but do reconsider just "giving him back"

What is he doing that you would want him out of the home?

If they wanted to screw the kid up completely, sure! I have no idea about the legal ramifications but from a moral viewpoint it's pretty sad that it's even a situation that needs to be considered. I just hope it's a hypothetical situation for an assignment or something and that no poor kid is really involved in this scenario.
