I took my kids to a home based daycare. She took a week vacation (unpaid) and all major holidays (x-mas, new years, thanksgiving, labor day, and a few more) were paid. I didn't have a problem with it, but she told me about it up front.That was in Maryland though. She also had a back up provider for her vacations. I was off work for the holidays so I didn't need a back up for them. If she needed a day off she also had a back up provider ready. In Maryland to have a home based daycare you are required to have at least 2 back up providers in case of an emergency. I'm not sure how Virginia does it. You should be able to call social services and ask what the regulations are.
(I also had to pay her for the days my kids were sick and didn't come to daycare. Her contract was set up a lot like a daycare centers would be.)

When I worked a daycare we got paid holidays and paid vacations jsut like a regular job.

Depends on what's agreed to between the provider and the parent, or between the child care center and its employee. It's not a matter of law, it's a matter of agreement.

My friend is a nanny and she gets all of that plus extra paid vacation whenever the parents go on vacation.

contact your local office of department of human resources. my guess is that if she is self employed and not registered by the state,she can charge you for holidays if she wants to. hope she told you this would be the case before you accepted her as your childcare provider.

Paid vacations yes, and hoildays yes. Only becuase we prepay for the whole week regardless.
