I got fired from my old job 2 months ago.(I was there 1 year) I had diagreaments with managment on certain issues and i refused to quit so they terminated me. I know got hired by a new employer. When the new employer asked why I explained that i was laid off. I did not want to say trhe word fired. They hired me . I gave them references from my previous job before the last one which I was at 15 years. They are now doing a credit and background check. They will not be calling my previous employer as I never gave them any numners but was curious if in my credit records or whatever records they get for a background check if they will somehow find out i was fired. Is there anywhere where that info can be gathered other than calling the employer themselves?? Little worried about starting this job and then getting let go before I even start.

I work in HR and know 75% of the people who claim to be laid off weren't. If they are are doing a backround & credit check, I assume you gave them permission to contact previous employers. They can call your previous employer (they can even find the phone number themselves), your old employer could also say you were terminated. If it was a large corporations their policy may be to only give out postion, title, and salary. However, if you worked for a small operation they may give out more information than they should. Most companies keep information to themselves because they can be sued for giving false information, but their have been companies that have ended up in litigation because they did not warn the employer of the employee (though this happens much less often). The law just requires them to tell the truth and they are not allowed to give information on personality or anthing else that is not tangible, unless they know first-hand. If they are smart they will not tell your potential employer anything that can not be proven in court.

I would not worry though. If they are going to consider your previous employer opinion, they will do it before you are hired, not after. Next time, be honest (or more honest) say I worked for a company for 15 years and made a mistake leaving because I didn't fit in well at the new job... Don't ever put the full blame on the employer. Let them know it was partly your fault and tell them how you wish you would have handled it. Companies like people who can own up to their mistakes and are and will look at how to improve themselves. Remember the person your talking to is an employer and if you start bashing a company they are not going to think highly of you.

They can only contact previous employers with your permission. And if they ask you about your previous job just tell them they let go because of personality conflicts with certain individuals.

NO, YOU REALLY DON'T HAVE TO WORRY ABOUT THAT BECAUSE I'M AT THIS CURRENT JOB NOW AND I TOLD THEM THAT I GOT LAID OFF AND I ACTUALLY GOT FIRED...SO IT'S BEEN 2 MONTHS NOWW!!! DON'T WORRY IT'LL BE OK!!

they are legally obligated to only give out position, and dates of employment. any other information given out without your written consent is ILLEGAL and should be reported.
