As others have said- homosexuals are still men and women! A gay woman is still a woman. A gay man is still a man. Hence, they use the men's or women's bathroom.
Transgender individuals (those who identify as both, or neither, or a mixture of the two sexes) are sometimes called the 'third sex', but most of them wouldn't like to use a bathroom designated 'whatever'- rather, unisex bathrooms or merely one of the two already available.

Um, howabout NO. Sex refers to physiology; there's already five possible sexes for someone to be born with; the two you know and love are just the most common. If you want to talk about GENDER, there you've got SOME point. But, ultimately, gender is so artificial in our society anyway that the sexuality violation of presumed gender roles isn't really much worse than, say, breadwinner roles and caretaker roles etc. What we SHOULD have is ONE bathroom, TONS of stalls with closing doors. Solve everyone's problems.
