I have a young child and I don't want to start up a big custody battle by setting the ball rolling. My husband walked out on us as soon as he acquired his indefinate leave to remain status from the home office(after one year and 6monhts in UK). It seems clear that he just me for a visa. He is not interested in his son and pays no maintenance. He has two children in Jamaica that he wants to bring to live in the UK. I am not sure if he thinks that the a divorce will affect their entry into the UK. I have lost a lot in this short marriage to this man and I just want to know if I can retrieve any money and stop him using his marriage to a british citizen as a meal ticket

You should first sue him for the maintenance of your child. You must do that first and then (i dont know the law in the UK) but in some countries you need to stay married a determined period of time to achieve citizenship...if he already has it then go to inmigration and make them know your situation. Be careful cause he has rights on his child too and he can have visiting hours but you should make the judge know that your child is in danger of being kidnap and he will have to see your child with the company of another person designated,
good luck

I'm not familiar with British law at all, but it sounds to me like you need to make an appointment with a lawyer (solicitor?) immediately. You need to protect your rights and the rights of your son.

The advantages are you stop this man from using you for his own gain, you can file for child support and he has to face up to his responsibilities, you free yourself from being a married woman so you can begin your life again.
