If you are taking an employer to small claims court for wages due, how can you get a copy of the employers payroll records to prove you were under paid without hiring a lawyer (they won't take the case because the $ amount is only $500 - which is a lot to me).

TN law says that all wages due must be paid (including vacation time if stated in company policy). Employer only paid employee 1 week (when due 2); however, other employees are still getting 2 (payroll records can prove that).

Really you need to expand on the basis of your claim, underpaid according to what? Chances are you will not get access to the employers payroll records for other people, so if you are alleging that you were shortchanged when comparing yourself to other employees, there are several factors that go into it. Even if you were represented by a lawyer, there's nothing forcing the employer to fork over his payroll records. Did he violate a law? In order to accurately assess your question, you need to provide more detail.

Subpoena them through the courts. They must bring those records with them anyways....So whether they provide them or not, they will have to provide them in court b/c if they don't bring them the judge will make it a court order.....and you'll see how quickly it appears.
