I contacted my landlord about two weeks ago, there are mice getting into my refrigerater! I have four kids and we have to order out food for all of our meals, the house behind me was condemned and gutted out, so it seems they ran into our homes, now we are fighting to get them out the fridge is very old so they just made it there home, My landlord told me she was going to come switch it out for us but never called us back! Could I take portion of my rent money and buy a new refrigerater? whats the law im in PA

Just a caution before you call the health department: you may need an alternate residence available.

When we called the health department in Michigan for having no working toilet, bathroom sink or kitchen sink, the health department came out, declared the property unliveable and gave us a three day eviction notice instead of forcing the landlady to fix the problem. My husband, two-year-old daughter and I were forced onto the streets with practically no notice whatsoever.

The refrigerator is not quite as bad an issue. My suggestion is to look in the paper and approach your landlord with a few options, both new and used. Explain that, while many people are urging you to go to the health department, you don't feel it's that serious of a problem and that you know the two of you can work it out yourselves. If she does indeed give you permission to get it yourselves, do follow the previous advice given and GET IT IN WRITING!

In the meantime, you may want to pick up a cooler for items such as milk, eggs, bread, etc. and continue using the freezer for ice and other items since I doubt those little furries are making their way up there, too.

Solution for the mice in general - mix dry concrete powder and flour half and half and leave in a bowl beside a bowl of water. Nasty indigestion will result and this mixture does not attract kids or other pets. Only downfall, finding the little buggers once they've gone to mousey heaven...

If the landlord is supposed to provide a new fridge, then don't buy one. You cannot deduct it from your rent, but if the landlord agrees to let you do that, get it in WRITING and SIGNED by both of you.

If the mice are that bad and literally in your fridge, you should consider calling the health department. Has the landlord done anything about the problem at all?
