I am married to a woman that I no longer love. She has a son with another man, who has not been around since the pregnancy. I have been providing for this child for over a year and I consider him my son. I want to get a divorce from my wife, but I don't know if my son will be taken care of if I am not around.I want to know if there is any way I could gain visitation rights if I agree to pay child support or if there is any other way for me to still see my son if I do get a divorce.

That is really sad. I don't believe that this will work unless you choose to adopt him. Or hopefully you can end the relationship peacefully so she will still be ok with you being in your sons life. I am not sure & the laws may vary from state to state. Best wishes to you.

I'm not really sure but I think u do not have any rights and u shouldn't pay child support (even if u want to) unless the boy is adopted by u. Anyway b4 you do anything see a lawyer there are always some way you can work out to see the boy after your divorce is final.

as far as legal side you might want to seek legal aid and see what your options would be.
other than that i think it you will need to have an understanding with your wife on how you feel about your son....however divorce is bitter and well she might not allow it at first out of anger....however the key point is that the child is not at fault and has no part in the decisions the parents are going to make....but especially in times like these your son will need both of your support even more... and well she needs to understand that....especially if your son is at an age where he understands changes and asks question " wheres daddy??" also your son deserves and explination on why you split up believe it or not. i think this will help your son cope on why you guys split and ensure to your son that it isnt his fault. the majority of divorces involving children, children belive is their fault....hope this helps and well i know it isnt easy.....good luck

I agree on the advice that you should DEFINITELY consult your lawyer. However, you may be able to fight for joint custody of the child considering you are his primary caretaker along with your wife. Also, if your name is on the birth certificate then you have a better chance to gain joint. ALSO, if you adopted him after he was born/got married then there is also a better chance to gain joint. Again, CONSULT YOUR LAWYER!

I WOULD work on the fact you dont like the mother.THE child may resent you in due season.

If your name isn't on his birth cert. then you have no rights, but maybe she will let you be in his life...GOOD luck..
