I need to know if I can take custody of my husbands children with a different woman? They are both serving time for child rape/abuse and the other thing is can my daughter recieve some sort of benefits while he is in prison.. he is doing 5 life terms.. ?

Yes. Correct me if I am wrong. But this sounds like a child abuse and neglect case. Check with your Child Welfare Agency. You can file for custody of the children because the parents are in prison. The only problem I can foresee is if there are other relatives who may be interested in caring for the children. Best of luck to you.

You must have permission from both parents and from the state. Your home must be checked by state authorities to assure the children are safe and taken care of.
Go immediately to social services and talk to them. Look in the "Yellow Pages" under "Social Work" to find many professionals who can help you. You probably need to have many witnesses to verify that you are a good mother and not abusive. If your love is true and your patience is high, check into. DO NOT DO THIS FOR THE MONEY. Please.
There are lawyers who handle cases like yours. Yellow pages again under lawyers, children's lawyers, or whatever sounds good, call.
You did not do anything wrong but I do not think that there is money for support. If he gets paid for working in prison, you may be able to collect that.
If you ever date again, think. Do not date anyone who smokes, drinks, does drugs, and is dirty, fowled mouth, and a fight starter. Stay out of bars and go to church so your daughter will learn to have a way of hope.
