My friend is about to take a job where they offered to pay her under the table. However, on the employment application, she remembered having given this employer her social security number.

My question is, since Susan's employer is paying her under the table, then please tell me why on earth did they need her social security number????

Does this mean they are planning on claiming her? Sh*t!!! if it DOES mean that, then could she get it big trouble?

If they're paying her under the table, then THEY can get in big trouble too, so I doubt they would report anything on her.
She probably filled out a standard application form. They all have that Q.

Watch out. At the end of the year, the employer might send her 1099. As a matter of fact, if the business is legal, they will want to claim what they pay your friend as expense. If they don't pay her salary, they can still pay her fee and give her 1099. If they do so, your friend will have to pay double the social security and medicare tax plus her own income tax. And the employer can use her social security number on 1099.

the only way she could get into trouble is if she doesn't report the wages to the IRS. The EMPLOYER, on the other hand, could face a whole host of troubles for "paying under the table".

Sounds shady to me. I would recommend having both parties fill out a 1099 form. It appears the employer doesn'r want to pay workers comp or other state and federal liabilities, which is fine, but get a 1099 form together.

Dude, just take the money and run. While I respect you for doing the right thing, don't be a rat and take out the employer. Don't worry about taxes for a simple 13.5 hours. If the IRS ever calls, just send them the money and its over. But don't make it a big deal. Legally though, if you wanted to try and pay the taxes, then find out how much would be deducted from the check, then send that much money to the IRS or whoever collects it by you. Technically, you are paying taxes and are striaght with the system. You just paid them in a different, unusual way. Good luck with your situation

It's standard to ask for your social security number on applications. A lot of companies use generic application forms. If their paying her under the table, than they're obviously not going to pay any taxes - and neither is your friend...so they won't do anything with her information.

The employer is probably keeping two sets of books.
Is she being paid under the table, or is she paid as an independent contractor?
If she is a contractor, the employer may file a 1099 on her.
If not, they may keep a second set of books in case they are investigated. It all stinks of fish to me.

Basically, that means they are going to try and say that she worked for them. However, if they do, that will backfire on them for paying her under the table...
she should tell them she wants a w2 and then when they ask why, she should tell them, because you have my social security number!!!

Seeing as how paying someone under the table is illegal, there is no reason for them to need her SSN.

they will probably try to call her an independent contractor and give her a 1099 form and she will have to pay taxes on all her income.
