Seriously, the CORRECT, LEGAL definition is ILLEGAL ALIEN under the U.S. Code. Look it up.
If they are an illegal alien, the evidence that they give is already " tainted evidence " because they are breaking the law in the first place. Any GOOD lawyer just needs to present that before the court. Case closed.

Yes, you would be charged because no court of law would want to create a precedent that killing an illegal immigrant is not an offense. Otherwise, people would go around running over illegal immigrants.
Also, your lawyers tactics can help you out depending on the situation on how the immigrant was hit. well, it comes down to technicality. But the bottom line is yes, you will be charged.

Maybe not because it would be more of a lawsuit and what grounds does an illegal immigrant have? Nothing he is already breaking the law to begin with.

true story here
guy shot an illegall immigrant and his lawyer got him off bc the illgal had no papers to show that he was a citizen of united states he had no social no passport or visa so technically he was not not here. so the guy who shot the illegal got off. The jury voted not guilty bc they could not prove that the guy he shot was acutally here.
