If I earned about $80k/year in the last few years, and then became
unemployed, do u think the judge will agree to set the child support
obligation acording to the lower unemployment earnings instead of
applying the formula to the $80k?
This is in a divorce case at the Supreme Court.

Please advise!

It depends upon the judge and the reason you lost your job. If there is a suspicion that you're remaining or became unemployed in order to avoid your child support obligation, the judge will not alter the CSSA award.

They base it on your previous W-2 form - whatever you grossed. 1 kid is 17% before taxes (YOU pay the tax, SHE gets it free & clear!), 2 kids 25%, and I'm not sure above that - I only got 2. The kids mom can go for an increase every 3 years, and if you do OT to make up for what you've been having taken out, they'll go for whatever your gross is, OT included.
