Differences in the DNA sequence of the promoters of the genes will lead to different rates of transcription. This is due to differences in the efficiency of RNA polymerase recognition of the promoter and hence transcription initiation. In addition, the amount of basal transcription will be influenced by what transcription factors may be constitutively recognizing any given promoter.
