The mother is stable and has been for 2 years, she is in school and working hard. She has always taken care of the children full time and only experienced extreme depression 2 years ago which required hospitalization to regulate meds. The father comes and goes, has a long history of domestic violence, ADHD, personality disorders and substance abuse but is holding a job now and has a college degree, although no formal treatment for substance abuse. He has a long crimial history and spent time in jail. whos fit?

Studies show that either one can cause some pretty serious damage to children. However, I would say that you are more at risk with the father. The mother seems to have gone through a bout of depression, which isnt abnormal considering the American Psychological Association has recently found that 1/3 of Americans will have a psychological disorder in the course of their lifetime. That's pretty big number. The father doesn't seem to have his problems under control nor has he made the effort to cured of his ailments. The mother has done both. I would side with her.

sounds like they both parents had/have issues and they both are doing things to make a better life. The children will suffer under both of the issues.Drug addiction is a disease just like bi polar you can't say one is better or worse BOTH are un chosen illness they require treatment. You don't cure bi polar or addiction both are only CONTROLLED they BOTH can come back. A good lawyer would agree neither is more fit. The dad already has a college degree and YOU DID NOT SAY HE WAS ACTICE USING only he had no formal treatemt there is a Major diffrence between no formal treatemt BUT NOT USING and being active in his addiction. As for jail thing as long as the jail thing was not related to child abuse or neglect a judge would ignore it unless his record had something to show he was a danger to his kids.

I would take the bipolar mother, at least with medication she can be a functioning parent and I would get rid of the rope around the family neck, a stealing, lying, won't work for long, crack head nothing. God bless your family and I hope your mother will get the strength to let your father go on about his crack headed business.
