Yes, yes, I know the obvious ones, as any citizen of the United States citizen would get arrested for robbery, drug possession, and other common crimes. I was really mad a few days ago because I was... well, you know, having a visit from Auntie Flo... and my teacher did not allow me to go to the bathroom. However, we have but three minutes between classes, and going to the bathroom involves a slingshot maneuver:

Seeing as there are but three minutes between classes, and that one would have to run to get to the bathroom (which, might I add, is always crowded), you would have to be The Flash or else be tardy to relieve yourself.

It all boils down to this. If I'm tardy, I get written up. If I use the bathroom during her class, I get written up (for she refuses to sign a hall pass).

Is she breaking the law by denying a student access to a school facility that is required by law to be there?

Well she is being uncaring for sure....Yes I do think that she was wrong...When I was a kid I had a teacher that had 2 girls that she had for pets,those girls were meaner than hell,and i hated those girls,they did all kinds of mean stuff to us even when we were just sitting there..She left them in command when she left the room,and they really was bad then and the teacher knew it.....I have always had a bad taste in my mouth about those kind of teachers....I think I would see the school nurse,counsler,or principle and let them know what she is doing....I always had a very suppotive mother and I was that way with my kids..I told them to ask to go to the bathroom and if they refused and they really had to go just go....Now that don,t mean to do it on purpose,thats in an emecency.....I told my small son one time ,it happened to him and he had a teacher like that,and I told him to ask and if she acted like that just pee in your pants and say you have to go home...I wouldn,t suggest that for you but that stupid not to let a child go to the bathroom

Because laws vary from state to state, it's hard to advise you. Some states have state teacher tenure laws; in others the issue is negotiated by each district and the local teachers' unions. If there is a state tenure law, then you may have tenure. The union contract defines who is in the bargaining unit. Perhaps you should be in it. Who told you that you aren't? Do you know anyone else in the district in a similar position? How is he/she treated? Generally the union wants to have more people in the bargaining unit. I'd suggest you contact the union and ask if you belong in the bargaining unit. (It probably would be best to talk with the executive director or the equivalent.) If the union thinks you belong in the bargaining unit, they can file for a unit clarification. Where I work, teachers in programs funded by grants are treated like anyone else. They can transfer to another position through the internal posting process and would be treated like any other displaced teacher if the grant was cancelled and the position eliminated. Anyway, I think that, unless there is something in the district's contract with the union that says you are not part of the bargaining unit, you are part of the bargaining unit and have tenure. You would then be treated like any other teacher whose current position is eliminated. I'd suggest you start by contacting the union.
