Why? it's copywrighted music. When someone buys a CD or an mp3 (from the yahoo music sites or iTunes) The record company makes money and the artest who produced the CD gets royalties. So if you download copywrighted music for free your basically taking their way to earn money.

not sure when. Why? The recording artist doesn't make any profit if people can download the product for free. Since you can download songs for about $.99 I think that is a fair price for their artistic endeavor. We can't complain.
