She can use whatever name she wants as long as she is not committing identity theft which it does not sound like that is the case. Your friend can file for a divorce if there truely was a common law marriage, and get half the debts and half the assets.

There's nothing really she can do. And how is it affecting the common law "wife"? And why would she care because if she knows her man is messing around what's the difference? I mean I know for some legal affairs, almost counts, but as far as legalizing documents, almost doesn't count. Now if you guys were technically "married", then that's a different story. And I know that because my mother is still under her married name and she didn't have to change it back, and she's divorced. Unless she's using it to get over on your friend, illegally or to do something criminal, there's nothing she can do because maybe he allowed it and it's his last name, so she might want to ask him that.. And just out of curiosity, why are you all up in your friend's personal affairs?

You can use any name you want. Its not hard to go down to the proper authorities and change your name to anything to want.
If I was that friend of yours I would tell him not to come home. If there was any papers filed by her then file the other papers to undo those bindings. I would then proceed with dividing up the assets or whatever and have her get out. The poor woman wasted 20 years with a cheater. How does she know he didn't do it before. And he had the nerve to leave her for another woman. She needs to repect herself and she will need your emotional support to get thru starting over.

Let's see, this guy who is the common law husband of one woman is now cheating on her with another woman who is using his name. HMMMMM Well if she is signing her name to any LEGAL documents you can have her arrested for false identity. If they have not gotten legally married and have not been together long enough to be common law then it is against the law for her to use his last name unless it is her last name as well. If she has changed it legally to his (gone to court to change her last name) there isn't anything you can do.

Anyone can change their name anytime to anything they want. As for caring about what a mistress does about someone's common-law husband...you're saying she's all okay with that cuz her estranged husband is using the mistress to pay off his bills? Sounds like a scam everyway ya look at the details and if I were you I wouldnt even get involved!!

shes not his wife what gave her the right to use it, the other woman has the same rights as she does and if the other lady and him goes across the state line they can get married just not in texas for 3 years went thru that 3 years ago wasted 20 years my heart goes out to her

She can't do anything. He can marry this other woman in a heartbeat and she can take his name. The real issue should be why would your friend want him to come home when he most likely was cheating on her?
