He is appealing it so he played yesterday and will play next week. His suspension will definitely be upheld so he'll miss 4 games, perhaps even the 2 Denver games. He would have been better off if he had not appealed it. They are in a division race with Denver and missing those 2 key games could be the difference makers. Take your medicine Merriman

He's appealing the suspension, until that is over, he himself is expecting to lose, he can play. Its all about making those 4 games he is going to miss happen at the best time in teh chargers schedule.

Players are allowed to play while their suspension is being appealed. If a player appeals, his suspension starts if and when his appeal is rejected by an independent arbitrator.
