You need to sit down and look at your Court Order Visitation Schedule. Then sit down with a calendar and notate the weekends you were supposed to get her but did not. If you remember the reason that was given, note those as well. Note any nights that you tried to call her and were not allowed to talk. Again, note the reason. Gather any proof you have of the child support you are paying. If you are paying through the Clerk of Court, you can get a print out. If you are paying her direct, then get your checks togehter. Once you have all of that, go to an attorney.

Your wife is in comtempt of court. Your attorney will get a hearing called "A rule to show cause". In that hearing the Judge will ask your wife why she isn't allowing visitation. Unless she has a valid reason, she will be ordered to allow you to see your daughter. If she continues to refuse, you will eventually end up with custody. You may want to consider fighting for custody at this point anyway.

All of that was contingent upon you having a court order with the visitation schedule spelled out. If the two of you worked things out yourselves and there is no court order, it changes just a little. You still need to get an attorney and gather all the things I mentioned above. He will get a hearing and a visitation schedule will be ordered.

Just be very sure that you are living a good life and not doing anything you don't want to be known about. If you make it to Court, there is a good chance your wife will try to come up with some sort of justification for the refusal of visitation (i.e. drugs, live in girlfriend, abuse, etc.) Keep your nose clean!

Documentation, documentation, documentation....very important that you get all of your ducks in a row. Your little girl deserves her daddy in her life. Fight the good fight and get you baby back...

Although you question isnt real clear, here is how it works. Weather you pay child support or not, she has no reason to keep your daughter from you unless you have a court ordered supervised visitation. She still cant keep her from you, but you would just have to follow the rules set forth. If you have normal visitation, and pay your child support, she is in violation of a court order, and can be prosectued for such. Any lawyer that is worth a breath of air is going to tell you, you need to show up on time to pick up you daughter when you are suppose to. If she wont allow this, documnent it each time as this shows a patteren when you go back to court. Also, you can take a copy of your divorce that shows you rights and a county sheriff and they can force her to follow the rules set forth by the court. but with out know you complete situation, that about the best I can do for you at the moment.

it doesn't matter if you pay suport or not, you are intitled to see your child. Go to the friend of the court and ask for a parenting time complaint form, fill it out and send it back. They will then contact her and ask her why she isn't keeping with the parenting time. Fill out these fors for every time she has denied you seeing her (from now on) she has three chances to comply with the judgges order or she is in contempt of court. Then if you want you can file for custody.

Your question isn't clear, who pays child support, you or her? Do you have joint custody? If you pay the proper support but your ex doesn't allow you to see your daughter, then talk to a lawyer to see what you can do.
