My wife left 3+ months ago. I filed for divorce about a month ago. My wife is now calling me telling me she wants stuff from the house. The house is in both our names, but I paid for it and all it's contents. I have a business trip for a few days that I need to go on. I am afraid that if she sees that I left, she will return and try to pillage the house. Any ideas on how I can keep her at bay?

Unless your petition stated who keeps what, and she filed a response agreeing to what the petition states, then there is not much you can do but change the locks and have a friend stay there to protect what is yours. She does have a right to collect her belonging, but you should be there when she does.

I think that until your divorce agreement is signed then she has the right to go into your house. It's hers too isn't it? If you are in Calif. then it gets split anyway. Unless the two of you agree otherwise. I think you should call her before you go and have her come over while you are home and get her stuff and then have a friend come and stay the time you are gone. How would the friend know what is hers or not, if she does come over while you are gone? I don't know very many people who would want to be in the middle of THAT. You might want to hire a guard! lol! Be fair! She is intitled to her belongings by law.

Well if the house is in her name also then I believe she has just enough right to be there as you do. As for the things in the house its community property. There is no court order saying she cant be there. You need to have a court order or some sort of temporary orders indicating that she is not to be in the house or take anything. Talk to your attorney see if he can do something fast before you go on your trip. Good Luck

Change the locks and hire a housesitter. Legally she's probably not allowed to go in the house but if she figures out no one is there she might try something and then you'll have to prove what she took. Too much work. Hire a housesitter with instructions to call the police if she shows her face.

It depends on what state you live in. In the great state of California once you file for divorce no one can take any property unless it is agreed upon. Sheesh will she rape you too? Ha ha ha (rape and pillage)

Get a restraining order that keeps her away from the house..
Hire someone to guard the house...

Same thing happened to me. Because it was a woman the cops did'nt care. I changed the locks and that stopped her.

change your locks, get a restraining order, can u get someone to house sit for you?
