We live in CA. He filed three years ago! I was with him, and I saw the paperwork.

Yes we have a lawyer. Yes, I have a ring. I told him years ago that as long as he filed for divorce I would be willing to persue a relationship with him. Of course I had no idea it would take this long. Our lawyer says that his ex has not filled out the required paperwork, so I guess my question is HOw long will the law allow her to hold up the divorce?

If it's that big of an issue how about finding a man who isn't married.

Anybody can file for a divorce, all that means is that it was filed. Divorce papers have to drawn up (usually by lawyers) and the person that filed needs to have the spouse either sign them or have them served. In most states, when papers are served they have 90 days (not sure about CA) to respond. Once papers are signed then a court date is set (usually right after the 90 days) and the judge hears the case, makes any determinations and the divorce is granted. If your fiance' filed three years ago and you have not seen anything since then, you need to ask him why he is not proceeding... No place in this country does it take three years to get divorced, not even for huge estates involving millions of dollars, children and huge estates...

Just because his ex hasnt filled out paper work doesnt leave a reason for it to take so long. There are people every day who get a divorce and the other person does not want to and doesnt sign the papers get a different lawyer and another opinion

Unfortunately, it can be many things. Maybe he never actually filed for the papers. Or both paties need to be available for signing. Why get involved with a married person in the first place. You should have waited until you knew for sure. Sometimes people who are seperating may try to work things out. Either way, I would get to the bottom of it. Ask him. If that does not work hire a private investigator. Why would he not do the same thing to you? Sorry to be so blunt, but truth is truth.

You really can't be engaged to a married man- so I think the fiance bit is a little premature.
Generally speaking, a divorce can take as few as 6 months. You should make sure that paper work was actually filed, rather than filled out to "show" you. You need to ask him, and if he gave you an engagement ring- give it back. Married men can't be engaged to other women.

A contested divorce takes time until both parties agree. If there is real state, miney and children in the midlle and two argumentative lawyers, then it can take longer until both of the parties are content with how to divide the assets, visitation, child support, etc.

Also, you may file for divorce and withdraw it if your change your mind.

I don't believe the divorce has been filed. He is not telling the truth. If possible you need to find out the truth from the lawyer.

go to the lawyer who is handling that case.. it shouldn't take so long for a simple divorce... even with property assess and child support and all that stuff... it shouldn't take so long,ask him to give you the lawyer who is in charge of this divorce number and if he doesnt give it to you.. then I would start to think they were papers for this divorce but no action... cause this things happend all the time,just because you filed for a divorce doesnt mean you went trough all the steps to follow it trough.... look out girl... good luck.

I'd give it a toss-up between the courts having their hands full, or the lawyers dragging their heals over it.... or the Fiances' ex. Wife is biding her time with her share of the paperwork as a way of getting back at him.

If the divorce is being contested, then it will go on until both parties agree, or until a judge declares them legally divorced. That question would best be put to your fiance.
