For any type of marriage, you have to go to a Court for divorce, through a professional serious advocate. See whether both of you need some councelling before coming to a conclusion. If nothing works out, there are two types of divorce under Hindu Marriage Law. 1. Dirvoce application from one of you (I dont remember that law). which takes much time more than three to four years. She will definitely ask for alimony or compensation. You will be directed to pay the fees of all kinds from your pocket to her. Court is sympathetic towards women in such cases. You have to prove through documentary evidences, on each and every thing as to why and how your wife is erring. many many things you will face and you will be dejected afterwards. It is a long proceeding. 2. Another Divorce is by mutual consent. In this both of you agree to become separate and ask for divorce. Here court will give six months time to both of you to reconcile. After the given period, one day will be fixed when your wife will be asked to take the bench and finally say she is not interested to continue her relationship with you. She already confesses that she needs nothing from you, except divorce, then the court will grant decree of divorce. If you are fortunate, if she agrees to this, your problem will be over in six months. Have you already married, as you are calling that woman, as your ex-wife in your question. If so, be careful, she may provide the evidence, when you will be sent to jail. When she attends to court herself, no problem. If she attend the court through a lawyer, he will certainly tutor her to ask all the compensation from you.

SUMMARY OF CASES IN THE LEGAL AID CELL
April 2001 - March 2002
1. X was married by fraud to a mentally disabled person 15-16 years back. From the wed-lock she has 2 children (one son 14 years old and one daughter 11 years old). She is living separately from her husband for more than 14 months along with her children at her parents place. She has already initiated proceedings for maintenance When she told us that she wants maintenance and divorce from her husband. We advised her that courts in Delhi do not have jurisdiction and thus we can draft the same for her and she can get it filed in the appropriate place on her own.
2. X, a major Hindu girl got married to her husband in Arya Samaj mandir on 15.02.2001 according to Hindu rites and ceremonies. She wanted to know how can she inform her family and what she should do before going to her in-laws who were in Allahabad. We informed her that she is a major and has a right to marry and thus she can inform her parents about the same. As far as visiting her in-laws at Allahabad is concerned we advised her to leave a information with her local police station via speed post or telegram that she has married and is going out of Delhi to Allahabad to visit her husband's family.
3. X, a 75 years old lady was being harassed by her younger son and his wife. She was owned property where the ground floor was her possession. The first and the second floor are being occupied by her younger son who is harassing her. She wanted to disown her son from the property and did not want to have any contact with him. We advised her to make a public notice in a newspaper to forewarn the public and inform them not to enter in any transaction with the younger son as he is not the rightful owner of the said property. We advised her to file a suit for evicting her younger son from the premises and file a suit for injunction from restraining her younger son and his family from entering into the ground floor premises and harassing her.
4. X, was a victim of domestic violence and mentally, physically and sexually harassed. She wanted to get divorce. We informed her the grounds of divorce as well as procedure for filing for divorce and advised her to file for divorce.
5. X who is a victim of domestic violence, approached us for legal help and advice. Her husband had been constantly threatening her that he will throw her out of the matrimonial home. We advised her to file a suit for injunction against her husband, restraining him from molesting her and from throwing her out of the matrimonial home. We also filed a suit for injunction alongwith application for interim injunctions. We got an interim maintenance from the court but as the client was an old lady, she was not very keen on pursuing the case and withdrew the same.
6. X and her husband and children were being harassed by her mother in law and were finally dispossessed from the house. The wanted to have their possession back. We advised them and filed for them a suit for restoration. Notice was issued and later on the parties withdrew the case.
7. X was a victim of domestic violence and wanted legal help and advice from us. She did not want to live with her husband and wanted dissolution of marriage. We accordingly have filed the petition for dissolution of marriage by a decree of divorce as well as for maintenance pendente lite. It is pending for adjudication.
8. X was deserted by her first husband within few months of her marriage and thereafter had a child from this wedlock. Some years later she married her husband's cousin, who used to ill-treat her since the beginning of her marriage and finally deserted her in some time. She wanted to claim maintenance for herself and her son. We advised her to file a maintenance application under section 125 of Cr.P.C
9. X was a victim of domestic violence and was thrown out of her matrimonial home. She wanted divorce from her husband and custody of her children. She was of the view that probably her husband may agree for divorce by mutual consent. We advised her to try for the same and if mutual consent divorce does not come through then advise her to file for dissolution of marriage.
10. X was married to her husband in the year 1980. She has daughter from the wed lock The husband threw and her daughter out of matrimonial home. She wants to get divorce and maintenance for herself and her daughter. We have filed divorce petition and maintenance application for her and her daughter, wherein proceedings are going on.
11. X was a victim of domestic violence and was constantly physically, financially and mentally abused by her husband. She wanted divorce and her stridhan back. We informed her of her rights and of legal options available to her.
12. X was treated with utmost cruelty by her husband and his family with constant demands of dowry. She was forced to leave the matrimonial home. She is working and wants to get divorce. We advised her that the same can be obtained and informed her of her legal options. As there were reconciliation attempts being made we assisted in arriving at the same.
13. X was being very badly harassed by her husband. He had also deserted her and her children. She wanted her stridhan back along with divorce and maintenance for herself and the children. We informed her of her legal options available and advised her to file for maintenance and divorce. She had already initiated criminal proceedings.
14. X and her two sisters were victim of eve teasing. When they went to the Police for help, they realized that they were also involved in the crime thus needed some action to be taken against the series of incidents happening. We advised them of legal recourse and informed them of all they could have done.
15. X was married in the year 1999 and her husband started drugging her forcefully and forced her to have treatment from psychiatrist. She was thereafter thrown out of her matrimonial home. She wanted to have maintenance and hence an application for the same was filed and in which the matter could settle at Rs.2,35,000/-
16. X was harassed by her husband and his family. She approached a reputed organisation where she was working and who provided counseling to her. The victim received a legal notice and we replied to it on her behalf and advised her to wait and watch as an what happens in counseling and accordingly take legal action. We however informed her of her legal options at that point of time.
17. X was a harassed by her mother in law and as the husband could not do anything about it he left the matrimonial home along with her and started living with her at his father's flat from where they were thrown out. She wanted to have her share in her father in laws self acquired property. We informed her that she does not have right in her father in laws property , what she can ask for is only maintenance from her husband.
18. X was severely harassed by her husband and her in laws and was forced to leave her matrimonial home. She wanted to take divorce and was of the view that her husband may agree for the same. We suggested her to go for mutual consent divorce.
19. X got married to her husband in 2001 and was having problems with her husband and his family since then. Off and on she used to patch up with her husband live with him but not for long. She wanted both legal and social intervention and we advised her on legal issues and referred for seeking social intervention to other organisation and referred her to Family Counseling Centre.
20. X is a victim of domestic violence, violence being manifested in both physical and mental forms. She came to us for legal advice. She wanted to get a divorce from her husband and did not want to live with him or go for reconciliation. We made her aware of options both in civil and criminal law. We advised her to go for judicial separation. We advised her to make a NCR with local police and send a legal notice to her husband and state that she was thrown out of her matrimonial home. We also informed her that she can then go for divorce, if need be.
21. X was being ill-treated with demands of dowry. She was thrown out of her matrimonial home. She wanted reconciliation but was apprehending a divorce on the ground of desertion. The reconciliation talks were going on we suggested her to make an NCR for now and see if reconciliation can take place, thereafter she can file for divorce if required.
22. X's mother approached us for advice for her daughters case who was being excessively abused by her husband since the beginning of the marriage. She wanted to reconcile the matter between her daughter and her husband. The daughter wanted to go for divorce as she was highly paranoid and was not ready to go back to her husband. We made them aware of their legal options and rights and asked them to decide on one of the option and get back to us.
23. X's first husband expired leaving a house whose power of attorney was in his favor. After his death, nobody came to them representing themselves as owner/s/ heirs of her husband. Though she did not have good relations with her father-in-law, who used to harass her, after her husband's death, he started living with her in her deceased husband's house. Later, X got married again with her father-in-law's consent, after which her father-in-law started threatening her not to claim any possession in her deceased husband's house. She wanted advise on what can she do avoid being threatened and not to lose possession of the house, in which she had been residing. We advised her and helped her getting the possession in the said house through Police.
24. X was having problem with her husband and got involved in some financial transaction carried out by her husband's brother. She was having some problem out of these financial transaction and she also wanted to know about options for how to get separated from her husband. We advised her on both the issues and details of various modes of divorce was explained to her.
25. X's marriage was an arranged marriage with her husband in the year 1999. Since the very beginning, she was facing lot of mental cruelty as because of her husband's conduct. Her husband was having illicit relations with his sister in law. She wanted a divorce and we have filed the same for her. In the same the parties have entered into a compromise and matter has been listed for follow up.
26. X was being harassed by her husband and his family. Her father in law used to harass her sexually and mentally. She had made a complaint against her husband and his family to Police. She wanted advice for future legal recourse and same was given to her. She was informed of legal options available to her.
27. X was mentally harassed by her husband and has exploited her and her family financially. She wanted to take divorce as was sure that there can be no reconciliation with her husband. We drafted the divorce Petition for her but same could not be filed as she had entered into some settlement with her husband and did not want to take any legal action at this point of time.
28. X was married to her husband in the year 1990 and has a son aged about 10 years. Her husband has died in the year 2000 and before his death he made a will in favour of X for all movable and immovable properties. We sent a legal notice to her husband's brother and his family and asked them to evict deceased's property and hand over all the movable property to X. Proceedings initiated in the form of letter of administration in that regard has been filed and is pending for adjudication.
29. X is an elderly lady who was married approximately 26 years back and since beginning she has been treated with extreme cruelty by her husband and his family which was manifested in both physical and mental manner. She wanted maintenance thus filed the maintenance application at Amroha for asking for maintenance from her husband. The Learned Court even ordered for Rs.300/- maintenance every month. The maintenance amount as ordered by court was never given to her by her husband. She wanted execution of the same which we informed that we can not do here in Delhi as the order is of Amroha court. We suggested her to file for maintenance case and claim maintenance from her sons (3 sons) who all are earning well, She has moved against her husband and his family under section 498-A, IPC in Crimes Against Women Cell.
30. X was treated with utmost cruelty and thrown out of her matrimonial home for more dowry. We have initiated both civil and criminal proceedings against her husband. We have filed a suit for permanent injunction, which is pending adjudication. We also drafted a criminal complaint for her against her husband and his relatives, which has been filed in the Crimes Against Women Cell.
31. X was a victim of domestic violence. She was treated badly by her husband and in-laws. She wanted to initiate some legal action against her husband and his family. We advised her of making complaint to CAW Cell and drafted the same for her.
32. X was a married lady who wanted to move out of her matrimonial relation and marry some one else. She wanted divorce by mutual consent and her stridhan. Her husband was not ready for divorce by mutual consent divorce nor return her stridhan. We informed her of her rights and grounds of divorce. She was of the view that she can convince her husband to go for mutual consent divorce and return her stridhan. We suggested her to first try to settle the dispute amicably and if not resolved she can take legal action .
33. X was married in the year 1994 and it was not disclosed at the time of marriage that her husband was already married and the same disclosed to her many years later. She was also treated with utmost cruelty and thus had to leave her matrimonial home. She wants divorce and stridhan back and also wants to initiate criminal action. The options available to her were informed and she was advised to initiate criminal action as well file for divorce and maintenance. FIR has been registered and divorce case is pending for adjudication.
34. X was harassed by her husband and his family members and there were also demands of bringing more dowry from her home. She was forced to leave her matrimonial house. She wanted divorce and maintenance. Her husband has filed restitution of conjugal rights petition. We advised her and informed her of legal options available to her. We are representing her in her litigation filed by husband.
35. X was treated with extreme cruelty, in addition to demands of dowry. On two occasions her husband and his family tried to kill her. She came to us and we advised her to initiate criminal proceedings in crime against women cell. We drafted a complaint and letter for Crime Against Women Cell.
36. X was severely physically and mentally harassed and financially exploited by her husband and his family with constant demands of dowry. Her husband used to always threaten her of throwing her out and finally she was thrown out of her matrimonial home. Her husband has initiated divorce proceeding. She wanted to know her rights and law related to matrimonial cases.
37. X was married in the year 2001 and was being harassed by her husband and approached us for help. We advised her to file a NCR and thereafter initiate proceedings before Crimes Against Women Cell if required. We drafted both for her thereafter there was a settlement between the parties.
38. X was a minor girl who was raped by her landlord and some family friend. The child has undergoing a serious mental trauma. She was so scarred that did not even inform her mother about her experience. We informed her mother about criminal complaints and entire trial procedure. They were informed about civil course of action which can be taken up by her so that she can claim damages for sexual assault.
39. X has faced extreme domestic violence by her husband and his family. Her husband initiated proceedings for judicial separation and we are representing her in that litigation. In judicial separation proceedings the reconciliation efforts were made and reconciliation could not take place and proceedings are pending.
40. X was married 10 years ago, had two children from the wedlock and died on 30th August 2001 under mysterious and unnatural circumstances. Her husband and his family claimed that she had committed suicide by hanging herself. Her father had made a criminal complaint against the husband of the deceased and his family. Her brother contacted us and we informed him of legal procedure and advised him to see to it that the evidence is collected properly and protected. We advised them to take the custody of the children.
41. X was married in the year 1982 and there was a history of mental and physical harassment by her husband and her in-laws. X has approached Crime Against Women Cell on desertion by her husband. She immolated herself after she came to know about a divorce petition filed by her husband on false allegations of cruelty by inflicted by her. We contacted X's father and informed him of legal options available in the light of circumstances we even approached her father but he informed us that he had already engaged a lawyer and would not need any kind of legal intervention.
42. X was a married for six years and wanted to terminate her pregnancy when she was 18 weeks' pregnant. Her mental health was said to be not fit and thus was sent for mental health examination but her husband was not agreeable The hospital authorities approached us whether they can legally perform the termination of pregnancy. We advised them accordingly in light of the Medical Termination of Pregnancy Act,1971.
43. X was Christian married in the year 1996. Immediately after the marriage the husband and her in laws used to harass her and demand dowry. X was still in her matrimonial home. Her father approached us for advice. We informed him about the legal options available and also told him about laws relating Christian marriage, divorce and restitution of conjugal rights. We also told him about the criminal law options.
44. X had faced severe sexual violence by her husband. She wanted to get divorce from her husband. We accordingly informed her of various grounds of divorce and drafted the divorce petition. Another criminal proceedings which were on going, we started assisting her in her case.
45. X was married in the year 1988. Her husband who is a heavy drunkard used to harass her both physically and mentally. She wanted to know about her right and remedies. She was informed of rights and remedies available to her and law related to marital problems.
46. X was living separately from her husband and wanted to make an attempt for reconciliation. We advised her of all legal options available to her and also referred her to AIWC for deciding on course of action. Her CAW Cell proceedings are going on.
47. X had faced severe harassment by her husband and her in-laws. All reconciliation attempts have failed We informed her of her legal reliefs available and was advised to initiate both civil and criminal proceedings. In view of the same maintenance application and criminal complaint was drafted and filed by us In her civil of maintenance case proceedings are going on and where else in her criminal case FIR has been registered.
48. X was treated with utmost cruelty and was finally killed for not bringing sufficient dowry. A criminal complaint was filed against her husband and his family members by the father of the deceased. Criminal case is pending in trial court at trial stage wherein we are assisting the prosecution.
49. X is a Muslim woman and has been divorced by her husband. She wanted maintenance and accordingly we advised her and drafted her maintenance application.
50. X is a victim of domestic violence and her husband also had illicit relation to which she objected very strongly. She moved out of her house because of her husband's not improving his behaviour. She was living in a shelter home and tried to get her stridhan back through shelter home authorities. She wanted her stridhan back and maintenance. We advised her to initiate criminal proceeding on account of harassment she was subjected to and for non return of stridhan.
51. X is a victim of rape. She approached us for legal help and advice. We have informed her of the criminal trial proceedings and our assisting her and the prosecution in the trial.
52. X is a widow and is living with he parents as husband's family refused to provide maintenance to her. She wanted to claim maintenance from her late husband's family. We informed her of her legal rights and options and drafted her maintenance application for her, from her father-in-law.
53. X was a victim of domestic violence which was manifested in the form of physical and mental cruelty. She wanted to reconcile the matter with her husband who has deserted her and left for madras after taking a voluntary retirement. We advised her not to go without taking intervention by Police. We even informed her about her right to maintenance and advised her to take appropriate action if he does not come back.
54. X is a deaf and dumb girl. The groom and his family was informed about the girl's being deaf and dumb. After some time of her marriage when she gave birth to a son who died within month of his birth. Since then she is not keeping good health and in such condition they forced her to leave the house and thus she is living with her parents. In the meanwhile a criminal case was registered against the girl for theft. X was not aware of as an what is happening in the matter. She wanted to get maintenance and divorce. We informed her of various grounds of divorce and what all is required to get maintenance. We even informed her that she can not file divorce or maintenance petition from Delhi. Moreover we informed her that she can make complaint with the women cell of her area.
55. X was a victim of severe domestic violence and due to ill-health and not being provided proper medical care and attention, she died during the delivery of her child. The father of the deceased approached us for legal advice and help. Before that he had approached her deceased daughter's husband who had taken the custody of the younger daughter and refused to take the custody of the elder one. They had approached the Juvenile Justice Board from where they got an order of Rs.400 as maintenance for the elder daughter but same was paid only twice. We filed an application for maintenance under section 125 of Cr.P.C. for the younger daughter. The matter is pending for adjudication.
56. X was a victim of domestic violence and was deserted by her husband. She wanted her stridhan back and maintenance thereafter. She was advised to make a complaint with Crime Against Women Cell for recovery and there after we moved an application under section 125 Cr. P.C. for maintenance.
57. X was severely harassed by her husband because of which she had to leave the matrimonial house. We advised her to file a suit for injunction and the same was filed and interim order in the form of no molestation orders have been obtained. The proceedings are going on in the matter.
58. X was a victim of harassment and her husband had taken her child mentally retarded child away and was trying to extort more money by taking away the child. We advised her to file for injunction.
59. X is a victim of domestic violence and had left her matrimonial house for some time and decided not to return after some time. In light of treats being received by her we have advised her to obtain injunction order where by an no contact and no harassment order will be passed against her husband.
60. X was a victim of violence and exploitation by her neighbor. Daughter-in-law of her neighbor was being harassed by her husband and her in-laws. X helped this victim of domestic violence, because of which, X was harassed by her neighbor. Strong allegations were made against her. She approached us for advice. We advised her to go to police and make criminal complaint for breach of peace. We also advised her to get the criminal case registered against her neighbor's by their daughter-in-law.
61. X was married in an Arya Samaj Mandir the year 2001 after a courtship period of 6-7 years. In matrimonial house she was ill treated from the day one and finally was thrown out of matrimonial home. She wanted a criminal case to be registered against her husband and his family. We advised her to make a complaint to the police and as there was an injunction suit filed her father in law we are representing her in that matter. Her husband has filed a suit for declaration of marriage to be null and void. We have filed an application for maintenance and are representing her in all the matters. Proceedings are going on in both the matters.
62. X is a victim of domestic violence. She has one child out of the wedlock . She wants divorce and custody of her children. We informed her of various grounds of divorce and law relating to custody. We even drafted the legal notice to her husband asking for availing the options of divorce by mutual consent but as client did not get back to us we did not send the same.
63. X is a divorcee living in her late parents house alone and her brother is living on the first floor of the same house. The brother has harassed her to get the property vacated. He had initiated a defamation suit and criminal defamation application against her and there is a probate case pending regarding the will of the mother pertaining to property wherein they are residing. We have advised her about suit for injunction, which she did not want to take up. We are representing her in defamation cases.
64. X is a divorced Muslim lady. She was both mentally and physically harassed by her husband and his mother. She initiated a criminal case for recovery of her stridhan and against cruelty she was subjected to. As the proceedings were getting delayed in the criminal case we sought direction from the High Court for expeditious disposal of the same.
65. X's brother came to us and informed us that X was in love with a person who has probably abducted her as she was missing. We advised him to first wait for her sister to contact and if she does not contact then we informed that he can file a writ to know the whereabouts and well-being of his sister.
66. X is a victim of domestic violence and was forced to leave her matrimonial home. She wanted to initiate criminal case against her husband and wanted her stridhan back as well as get maintenance. We advised her to first file a complaint at Asansol and get her jewelry out of the locker there. We drafted the complaint and for maintenance also as soon as she gets her jewelry same will be filed.
67. X was a victim of domestic violence and her husband also had illicit relation. X wanted divorce and her stridhan back. We informed her of her rights and laws related to matrimonial cases. She got her complaint registered and could recover some of her stridhan as on date.
68. X is a victim of severe physical and mental harassment. Her husband remarried while still being married to her. We informed the client about her legal rights, grounds of divorce and laws related to bigamy. We are representing her in criminal case initiated against her husband for return of stridhan and against harassment inflicted upon her. The husband has filed for custody of the child who is in his custody as of now we are representing X in the same.
69. X is a victim of severe sexual, physical and mental harassment. She had two children from the wed-lock. We advised her for obtaining restraining order restraining her husband from contacting her and informed her about various grounds for divorce and how to get maintenance. As she was emotionally very disturbed we referred her to a counseling Centre for counseling after which we can initiate legal proceedings against her husband.
70. X was married in the year 1999. As it as a love marriage her in-laws and rest of her husband's family ill-treated her and the couple was forced to leave the house. They were living separately for two to three years when her in laws took them back to matrimonial home. Where she was again both mentally and physically harassed. We have referred her to a family counseling Centre .
71. X was a widow living alone with her children. She was harassed by her neighbors. She wanted advice as what she can do without going to the court. We advised her to send a legal notice to her neighbor and if condition do not improve there after we advised her to make a criminal complaint against her neighbor.
72. X was married in the year 1996 and within a month of the marriage she was subjected to severe mental and physical cruelty for bringing less dowry. She was thrown out of matrimonial house without her elder son. We advised her and accordingly sent a legal notice for giving the custody of the son to X and filed the application for custody and maintenance. The matters are pending for adjudication before the Hon'ble Court and we are following it.
73. X is a victim of rape. She was raped twice when she was in the state of unconsciousness after being made to eat some sweets. The matter is pending trial in which we are assisting her prepare for her evidence.
74. X is a case of sexual harassment at work place. X had initiated the required proceedings by making complaint against the accused person She sought our advise and we have given our legal opinion in this regard.
75. X was a widow and he father in law was harassing her by denying her any right in her deceased husband's self acquired property. She wanted her right in her husband's property. We informed her of her rights to property in her husband's self acquired property. She wanted to settle the matter outside the court. We advised her to send her father in law a legal notice informing him of her intent.
76. X is a victim of sexual harassment at work place. She wanted our legal advise. We informed her of laws relating to sexual harassment at work place. We advised her to ask for holding a meeting of all members of the Committee and explain there that the committee looking into her matter has not done the enquiry properly.
77. X was a victim of harassment manifested in both physical and mental harassment. She had to leave the matrimonial home in the wake of the violence. She wanted reconciliation and attempts for the same were being made. We advised her to have joint agreement with her husband before join him in the matrimonial home.
78. X was deserted by her husband and her husband was also missing for last two years. She wanted to get divorce from her husband. We informed her about grounds of divorce and time taken in proceedings for divorce.
79. X was not provided with maintenance by her father and had left her parental home because of these reason. We advised her to first send a legal notice and then move an application for maintenance if required.
80. X was a victim of severe harassment at her matrimonial home. She had to leave her matrimonial home for the above noted reason. She wanted to know her legal rights and wanted advice for what she should do. We referred the client to the counselling so that she can get focus in her life. She has informed us of getting more focused in her life. She would like to take any legal action after she is through with her counselling.
81. X is a victim of domestic violence manifested in the form of extreme mental cruelty. She was thrown out of her matrimonial along with her son. Immediately her mother-in-law who was the owner of the matrimonial home filed an injunction application against her son and X restraining them to enter the matrimonial home. She has got an ex-parte status quo order in her favour. We advised her to initiate criminal case against her husband and his family and the same complaint was drafted by us and filed in Crimes Against Women Cell wherein proceeding are going on in. Her husband has filed a divorce petition and we have moved a maintenance application for X and her son. Proceedings are going on in all the cases.
82. X was a victim of mental and physical harassment. She had already registered a criminal case against her husband and his relatives. The husband himself was in the US. She also had two lawyers who were looking after her case. We gave her all the necessary legal advice whenever she came to our office for the same or called us on the telephone but we were unable to take on this case for legal representation in courts as she was earning much above Rs. 15,000 which is our upper slab for taking on clients for legal aid.
83. X was a Muslim lady who had been a victim of domestic violence. She also had a one year old child her husband was in Bihar and she wanted a divorce from him. We explained to her the grounds of divorce and about her right to maintenance. She was also explained that she could not file a divorce in Delhi because of lack of jurisdiction in the courts of Delhi.
84. X was made to sign on mutual consent divorce petition by fraud and force. She was made to state on oath that she has received all her stridhan, she does not want maintenance or custody of her three children. She has approached many lawyers since then but could not take any action because of her being unable to pay them their fees. After about six years of her divorce by mutual consent she wanted to initiate some proceedings against her husband and also help her daughter who is in his custody and is being harassed. As courts in Delhi do not have jurisdiction and the X and her daughter both can claim maintenance in courts at Meerut.
85. X was thrown out of her home 8-10 years back, after which she came in contact with a person who is in the business of prostitution and by exploiting her vulnerability he dragged her in the profession of prostitution. When she has looked for a match for herself the man who dragged her to prostitution threatened her and her fiancée to kill if they plan to marry. We advised her to first send a legal notice to the pimp and if required there after she can take help of Police. We drafted and sent the legal notice.
86. X was a victim of domestic violence and after a long time she managed to come to her parents place. She wanted to get divorce and was very scared of her in-laws and did not want to return to her matrimonial home. We informed her of her rights and advised her to make a criminal complaint in Crime against Women Cell against her husband and his family, file for divorce and maintenance.
87. X was a child being abused by his father after death of his mother. He wanted to have no contact with his father and wanted to have maintenance and did not want to be under his father's guardianship and restrain his father from selling the house. We informed him and his uncle who has his custody that as the property is jointly owned by the father of the child and uncle thus without the consent of uncle. We advised to get injunction order for the child.
88. X was a victim of domestic violence inflicted upon her by her husband and father in law and mother in law. She had already initiated criminal proceedings against her husband and his family and also filed a divorce petition at Kolkata. She wanted maintenance. We advised her to file a maintenance application in competent court at Kolkata.
89. X is being extremely harassed by her mother in law and she came to us to take advise from as to what can she do to put an end to the harassment. We informed her and advised her that she can get a restraining order stopping her from contacting X as well as can make a criminal complaint against her mother in law.
90. X, a jhuggi dweller approached us as she alongwith others in the same jhuggi cluster were being dislocated from the slum without any proper relocation plan for them. We intervened on behalf of all the people residing in the locality (about 785 families) and approached the High Court by way of a writ petition. In the petition, we got appropriate directions for relocation and rehabilitation to a developed JJ-cluster on the outskirts of Delhi. The Court also constituted a grievance committee, of which we are also a member and we are continuing to assist the court in complete rehabilitation and monitoring the process.
91. X was subjected to severe physical and mental cruelty and was thrown out of her matrimonial home. Illegal termination of her pregnancy was fraudulently done by her husband and his family. She has made a criminal complaint against her husband and his family. The husband and his family has taken anticipatory bail and have not returned her stridhan. The husband has filed a divorce petition and she has filed a maintenance application. In all the criminal and civil matters the proceedings are going on.
92. X was a victim of domestic violence and when was assaulted she left the matrimonial home and started living with them. Her husband filed a petition for restitution of conjugal rights which he withdrew after it was transferred to the place where she is residing. He filed a divorce petition in which a compromise was arrived at for a settlement of Rs. 20,00,000/. Now when the matter is listed for mutual consent divorce in Delhi, she apprehends that they will not stand by their commitment. She wanted advice in this regard. We advised her to state all the settlement conditions before the court immediately and then if they back out, she should not sign mutual consent divorce petition.
93. X was a victim of domestic violence for 30 years and wanted to have an order stopping this violence. We advised her about obtaining injunction order restraining her husband to harass her enter the house. We even advised her to claim maintenance from her husband or her son whoever is earning.

We advise her to take restraining order from illegally dispossessing her and from harassing and molesting her. She was also informed about filing a criminal complaint in women cell against all of her family members at matrimonial home.
102. X was a widow and her husband has died and left a will in her favour bequeathing all the property in her and in the children's name. But a man named Y occupied the house and was claiming to be the owner. There was a case of injunction pending between the parties filed by some other lawyer. There was a fight between them and thus proceedings for breech of peace were initiated against her. she wanted legal advise with regard to appropriate course of action. We asked for the documents and advised her to obtain injunction order.
103. X was a victim of domestic violence. The violence was perpetrated by her husband and his family. She wanted divorce and wanted to initiate criminal action against her husband and his family. We informed her of her rights of maintenance and grounds of divorce along with procedure and requirement for registration of criminal case.

She wanted to know how can she register her marriage without changing her religion and what she has to do so that no criminal case of abduction is made out against her husband. We informed her to register her marriage under special marriages act and inform the police that she is living with her husband out of her own will and has married him in accordance of law. Letter to her local police station was drafted and sent by us.
106. X was a victim of domestic violence and was deserted by her husband. Her husband had initiated a case for restitution of conjugal rights and when she could get it transferred to her parental town he withdrew the case and filed a divorce petition, which at the stage of transfer compromised and the husband agreed to pay Rs.20,00,000 in lieu of stridhan and Rs. 20,00,000 for maintenance of X and her daughter. Mutual consent divorce petition is pending at Karkardooma. She wanted divorce and maintenance along with her stridhan/money in lieu of her stridhan. We advised her to not to sign the second motion divorce until unless full and final payment is not made.
107. X was a victim of Domestic Violence and was living separately from her husband for 7 years. She had already initiated civil proceedings for divorce and maintenance wherein interim maintenance was granted we advised her to file for enhancement of maintenance amount.

We referred the case to our partner in Bangalore, who is now attending to the case. We have informed her that the jurisdiction to file for divorce is in Agra and not in Delhi but we have told her that an application for maintenance can be filed in Delhi, on which we are working and it will be filed very soon.
124. X lives in Dehradun and was married in Ahmedabad. Her husband used to harass her a lot and she was then thrown out of the matrimonial home. She came to us for legal advise and intervention. She wanted to claim maintenance from her husband and also make a criminal complaint against her husband and in-laws. We are drafting an application for claiming maintenance for her and also a criminal complaint to be filed in the Crimes Against Women Cell.
125. X lives in UP and her husband has been very abusive towards her. She had registered an FIR against her husband in Jaunpur, on which the accused husband got a stay of arrest by moving the High Court by way of a writ petition. She wants us to move the Supreme Court in this case and challenge the stay of his arrest. We have asked her to send the relevant documents to us to study and draft an appropriate plaint to be filed.
126. X had been living separately from her husband for over six years and she wanted to get divorced from him. We advised her to try for divorce by mutual consent, to which her husband agreed. We drafted the terms of agreement for their divorce and also the divorce petition. We have filed the petition, on which an order will be passed very soon.
127. X's husband and in-laws had been demanding huge sums of money from her father, which the father could not afford to pay. Her husband also used to beat her very badly very frequently. We advised her of her rights and legal remedies available to her. As per her instructions, we drafted a criminal complaint for cruelty against her, which has been filed in the Crimes Against Women Cell and the same is pending.
128. X alongwith her husband came for legal advise. They have been thrown out of the home where they used to live, which is owned by her husband's father. X has filed a complaint in the CAW Cell, which is also against her husband as well, but now she has reconciled with her husband. She had also made an allegation for breach of trust regarding her stridhan against her in-laws, but she had given them her jewellery for selling it off to build their house. We advised them that the charges of breach of entrustment cannot be pressed against her in-laws as she had wilfully given the jewellery to them, knowing that it will be sold. We also told her that she should make a statement in the CAW Cell that she does not want to pursue her complaint vis-à-vis her husband.
129. X's husband died and she wants to claim maintenance from her father-in-law. Her father-in-law has been stating that he is willing to maintain her if she lives with him. She is fearful in living with him as she has earlier been abused by him. We informed her of her right under Hindu law to claim maintenance from her father-in-law from his ancestral estate.
