if divorce for a year in some states not just seperated divorce you can marry some is 6 months check with the court house and then get divorced and wait it out

No restrictions after a divorce is final. For all couples who apply for a marriage license, 24 hours waiting period prior to marriage.
Make sure you check with your local marriage license office or county clerk to make sure that state requirements haven't changed.

I believe the next day but I would wait at least 30 days. You can always ask a lawyer to be sure.
