Sounds like you need a new lawyer. These things take time but your lawyer should have filed an amount to get the ball rolling. The party involved if they had insurance then the insurance company will want to settle out of court if possible. They need some idea of what kind of money you are talking about. All lawyers should be shot. They are always in it for the money and couldn't give too hoots about their clients hardships. If the individual didn't have insurance then you may never get anything. Sure you can try to collect if he ever has anything in his name but thats unlikely. Not what you wanted to hear but this is facts.

I work for a personal injury firm and I can honestly tell you that there are many cases that take longer than 1 year, 2 years, some can even go for 5 years. He is not going to sit there and tell you that your case is worth this much b/c lets say your case doesn't settle for that much, you will have a heart attack and flip out on him and tell him that he didn't do his job.

A factor to settling your case also has to do with the insurance company you are dealing with. If the insurance company is Allstate, you will have to fight til the very end no matter what injuries were sustained. Some insurance companies like to get the case settled early and some don't.

Another factor, injuries. Just b/c your son could've died but didn't what injuries did he sustain. You are talking life threatening injuries right? Would you like your attorney to take any settlement offered just to settle your case? No.

If you pressure your attorney to settle your case, what's going to happen is you will get lowballed. The defendant's insurance company and/or attorney will come with a low figure b/c they figure you are desperate and are willing to take anything offered.

Your attorney would've probably settled your case, if it wasn't a huge case. Do you want him to accept anything that is offered? No. I bet you don't. So relax. Patience is a Virtue.

sorry to say it, but these cases can take years. I hope your lawyer is working at a set percentage, rather than an hourly rate.

A long time, but it will go quicker if you spend some of time exercising your right to punctuate.
