It depends a lot of the country you intend to publish in. In some places you need Government approval and a license, whereas in others you don't and can publish just about anything.
You shoud also check the relevent media laws in your country too, or hire journalists that know and understand the regulations.
It's a tough process though. Even experienced publishers will take 12-18 months from inception to launch a new title. They need to research the market and be sure advertisers will pay money to appear within it.

If it is a profit venture, then register the magazine's name with the concerned agency. There is no need for the services of a lawyer.
