I bought a cd fron ebay seller and requested mail tracking number. I received email with tracking number stating delivery within 2-9 days. Never came. Post Office says contact seller. Seller doesn't respond to email. I check sellers feedback and see that everyone who bought from this seller got burned and ebay has cancelled the seller.

I started the ebay/paypal dispute process but it sounds like steps take a long time to resolve and paypal might not do much. Since this looks like clear fraud I emailed paypal to see if refunds could be expedited. No response yet but it has only been a day.

Since I paid thru paypal with a credit card can I just go to my bank and request a chargeback? Would I be doing this anyway sometime in the paypal dispute process?

Finally, since the seller used the Post Ofiice by issuing a tracking number to delay discover of their fraud does this escalate their crime to mail fraud?

Thanks for the help!

Paypal has BUYER protection for you. Start there, they will get you your money back. Also call your credit card company.

Hi there.

You can go online usps.com and file a mail fraud claim against the fraud.

Secondly, if it has not arrived to you, Paypal's dispute process will take no more than 10 days in most cases.

Thirdly, to bypass Paypal and whatever hoops and loops you may have to endure, just file a fraud complaint with your bank on the credit card. That is a surety to getting your money back the fastest, but the second option above should work. If not, use this third.

eBay and Paypal think they are invinceable...be careful.

Call your credit card company and file a dispute. They would not charge your account until the case is resolved. Paypal will be dealing directly with your credit card company. To report a postal mail fraud, you need to file a report at the postal inspector's office. (I don't know if they have a specific web site). However, it's not like they are going to go after the guy tomorrow. You will not even hear about it. So, it is totally up to you.

Make sure you write a letter to your credit card company for the dispute. They might send you a form letter to fill out, but talking to them on the phone does not count as a charge back. You need to write a letter. Check the back of your credit card statement to find out the details and how long you have.

You have to let the ebay process take its time. The only quick way would have been to check the FB before buying.
