He will still owe her the monthly amount due. The employer should still be withholding from his sick/vacation time. If he has none left then he will just owe her arrears and depending on your state interest on that balance. Has your daughter signed up for assistance in human services? If she has not-have her do so. (Food Stamps, medical assistance--anything she can qualify for.)This will compel the state to enforce the order. Your ex son in laws new wife's income is not a factor, but if he gets behind enough--they can seize his tax return to pay off arrears. If he has become 'disabled' have your daughter contact social security - she can collect on behalf of their common children. However, gall stones should not have him out of work for more than a few weeks. I would also suggest that your daughter talk to the child support office and ask that her child support be reviewed (if his income has increased since their divorce). Most people don't know to ask for a review and take the amount set at the original divorce forever. Good luck!

If he was court ordered to pay child support, then he has to pay it no matter what. Your daughter could go down to legal aid and ask for help. Her exhusband has enough assets to suport his 4 children while he is out sick.
